DPC Continues Outreach to Protect Patients’ Rights

DPC Members and Patient Ambassadors continue advocacy on H.R. 8594/S. 4750 - The Restore Protections for Dialysis Patients Act, which would codify into law the right for dialysis patients to stay on their private insurance for up to 30 months, if they should so choose. This bill not only preserves patient choice but also encourages insurers to detect and treat kidney disease early and, most importantly, protects kidney disease patients from discrimination. This legislation reinstates the importance of allowing kidney patients to decide which health insurance will best serve them. Congress needs to protect kidney patients following Supreme Court decision

I recently joined other dialysis patients in meetings with Congress to discuss the challenges we face. One of the key topics we covered was how hard it is for patients to get access to the benefits and coverage we need just to survive. Those challenges are about to get much bigger for many patients after a recent Supreme Court decision. The decision could limit benefits and make it easier for private insurers to move patients off their employer-sponsored coverage and onto Medicare before the traditional 30-month point after they are diagnosed, limiting patients’ access to benefits Medicare doesn’t cover for [...]

Action Alert – Protect ESRD Patient Access to Private Coverage

2024-03-29T01:09:22+00:00August 19th, 2022|Categories: Article, Private Insurance Coverage, Protect Patient Care, Take Action|

Ask your representative to co-sponsor H.R. 8594/S. 4750, legislation that would protect ESRD patients by allowing them to maintain private, employer health coverage up to 30 months after diagnosis with kidney failure. A recent Supreme Court ruling now threatens their access to private coverage by permitting health plans to carve off dialysis benefits from their networks and impose restrictive terms on kidney patients.  The continuation of high-quality care and benefits during this 30-month coordination period helps kidney patient’s successfully transition into life on dialysis and/or kidney transplantation. Leave your legacy through advocacy and urge your representative to co-sponsor this life-saving legislation and restore the protections [...]

Dialysis patients counting on Congress

It’s quite the experience being a kidney patient on dialysis. There’s always new information to monitor and communication to track between various medical providers, dialysis centers, and health insurance entities. It’s important for patients to educate themselves on kidney disease to best serve themselves and others who are on dialysis. One area of dialysis that can be hard to navigate is health care coverage. As both a dialysis patient and transplant recipient, I’ve been fortunate to have both employer-sponsored insurance and coverage through the Department of Veterans Affairs. It’s essential that dialysis patients can remain on employer-sponsored insurance for 30 [...]

WASHINGTON, D.C. (August 1, 2022) -- Dialysis Patient Citizens (DPC) today released the following statement applauding the introduction of H.R. 8594 by Representatives Yvette Clarke (D-NY-9), Buddy Carter (R-GA-1), Jodey Arrington, (R-TX-19), and Danny Davis (D-IL-7) to prohibit discrimination against dialysis patients in insurance coverage. “We thank Representatives Clarke, Carter, Arrington, and Davis for introducing this essential piece of legislation that will protect dialysis patients from facing unjust discrimination in their health coverage,” said DPC Board President Andrew Conkling. “Dialysis patients have a right to continue on employer-provided plans for 30 months after being diagnosed with End-Stage Renal Disease (ESRD), [...]

Supreme Court Erases Kidney Patients’ Insurance Protections

A U.S. Supreme Court ruling has nullified the law that protects dialysis patients from discrimination by insurers, threatening the system of financing kidney care that has stood for 40 years. The Court ruled that employer health plans may limit dialysis benefits. For four decades, employers understood the law as prohibiting limitations that only applied to dialysis. Some health benefit consultants encouraged a few small employers to disregard the law by paying no more than Medicare rates for dialysis. DaVita sued them, and one of the cases was appealed to the Supreme Court. The decision means that employers and insurers can [...]

Dialysis Patient Citizens Statement Following Supreme Court Decision in Marietta Memorial Hospital v. Davita

WASHINGTON, D.C., (June 21, 2022) -- Following the United States Supreme Court decision in the case of Marietta Memorial Hospital v. Davita, Dialysis Patient Citizens (DPC) Board of Directors President Andrew Conkling issued the following statement: “DPC is deeply disappointed by today’s Supreme Court decision,” said DPC Board President Andrew Conkling. “Congress long ago reaffirmed privately-insured patients’ right to continue on their employer-sponsored plan for 30 months. This played an important role in preserving patient choice and incentivizing insurers to detect and treat Chronic Kidney Disease. ESRD patients are among the most vulnerable Americans and face some of the largest [...]

DPC Files Amicus Brief in Supreme Court Case

DPC filed a “friend of the court” brief in the U.S. Supreme Court case of Marietta Memorial Hospital v. DaVita. The case involves a dialysis patient whose employer-sponsored health insurance plan tied reimbursements for dialysis to Medicare prices. The Sixth Circuit Court of Appeals held that this constituted illegal discrimination. The employer appealed the decision, which is now scheduled for oral arguments before the U.S. Supreme Court on March 1. DPC’s brief argues that such discrimination circumvents dialysis patients’ right to keep their employer coverage for up to 30 months before Medicare becomes their private insurance. DPC emphasized the three [...]

DPC Advocates for Patient Access to Private Health Insurance

DPC filed an amicus brief in support of a lawsuit to protect patient access to private health insurance coverage. This is one of a number of lawsuits challenging discrimination by employer health plans in how they pay for dialysis. End-Stage Renal Disease (ESRD) patients are protected by the Medicare Secondary Payer Act (MSP), which permits ESRD patients to remain on their private health insurance plans for 30 months before they must enroll in Medicare. To protect this right from being chipped away, Congress prohibited health plans from making any distinctions in how they cover dialysis relative to how other treatments or diseases are [...]

Currently, dialysis patients are restricted to 30 months on private insurance coverage before having to go into Medicare. The House of Representatives recently proposed extending this length of time by three months, which is estimated to save Medicare $344 million. Access to private insurance is critical for dialysis patients, and we are very appreciative of the House’s efforts to improve that access. Read our letter below in support of this proposal: Dear Leader McConnell, Minority Leader Schumer, Chairman Hatch, and Ranking Member Wyden: As America’s largest patient-led kidney disease organization representing over 30,000 dialysis patients and family members, Dialysis Patient [...]
